Privacy Statement Libéma Events

Libéma Events B.V. (“Libéma Events”) is a subsidiary of Libéma Exploitatie B.V. (“Libéma”). Libéma and its affiliated companies, including Libéma Events, attach great importance to protecting the privacy of their (potential) customers and visitors to its parks, the website www.libema.nl and the other Libéma related websites (“Websites”). In order to carry out our activities properly, it is sometimes necessary to process your personal data. We always do this carefully and in accordance with the law and our internal privacy policy.

In this Privacy Statement we inform you about the processing of your personal data by Libéma. We describe why we process your data, how we do it and what rights you have in doing so (such as your right of access and the right to object to the processing of your data). Most of the personal data we collect and use is necessary to perform our agreement with you. In some cases, we also use your data for marketing purposes.

  1. Who is responsible for processing your data?

Libéma Exploitatie B.V. (“Libéma”), located at Graafsebaan 133 in (5248NL) Rosmalen, is responsible for the processing of your personal data by all companies affiliated with Libéma. Libéma uses various systems for the processing of your personal data (such as office automation systems, administration systems and website hosting applications). The suppliers of these systems can therefore also process your personal data on behalf of Libéma. Libéma has made agreements with these parties so that there are sufficient guarantees for the careful processing of your personal data, in accordance with the law and Libéma’s internal privacy policy and this privacy statement.

  1. When do we process your personal data?

Libéma records your data when selling its products and services (such as e-tickets), when providing its services and in the other cases that Libéma has contact with you. You can think of your name, your address, your e-mail address, your telephone number, your date of birth and your bank details. General visitor data is kept on the Websites without identifying visitors to the Websites.

  1. Why do we process your personal data?

Libéma mainly uses this data to provide our services to you and for service purposes. We also use the data to protect our property and employees.

The registration of data via the Websites is aimed at further optimizing the services of Libéma, among other things by adapting the layout of the Websites as much as possible to the needs of visitors and by placing more specific information on the Websites.

Libéma also uses personal data to gain insight into the preferences and interests of its (potential) customers and visitors to the Websites and to process bookings and e-tickets. Libéma also uses this data for its services and to keep its (potential) customers and visitors to the Websites informed about Libéma’s activities, products and services and to possibly conduct market research. In doing so, Libéma tries to take your interests into account. Data from its (potential) customers and visitors to the Websites also help Libéma to develop new services and products.

  1. Why are we allowed to process your data?

Libéma may use your personal data, because this is necessary for:

  • the execution of the agreement with you, such as the use of your contact details and account number when you make a reservation with us;
  • compliance with a legal obligation resting on Libéma, such as providing invoices to the tax authorities or cooperating with a request from the competent authorities;
  • representing the legitimate interest of Libéma or third parties (insofar as this takes precedence over your privacy interest). That legitimate interest is the interest of Libéma to be able to offer its products and services to its relations as efficiently as possible;

In some cases, Libéma may only process your data if you have given permission to do so, for example if we need to process data about your health if you use a certain attraction (such as the Climbing Park) or if we use photos on which you are recognisably depicted. You can revoke that consent at any time.

  1. How long do we keep your data?

Libéma does not store data for longer than is necessary for the performance of our activities, unless the data must be kept longer on the basis of a legal regulation. Most data will be deleted within two years after our business relationship with you has ended.

  1. What do we do with the data that we automatically collect when you visit the website (cookies)?

Libéma uses cookies when offering its services. This is a simple small file of data that is stored on your computer’s hard drive. Libéma uses both temporary cookies and special cookies. Temporary cookies do not contain any personal data and are only intended to make it easier for you to use the Websites. Special cookies are used to recognize you when you visit the Websites again. For example, they ensure that your settings are remembered, such as your name and date of birth.

  1. When and how do we use your data for sending newsletters and other commercial messages?

Libéma would like to keep its (potential) customers and visitors to the Websites informed about its products and services. When you subscribe to an electronic newsletter from Libéma, you give permission to Libéma to use your e-mail address to send that newsletter and other information from Libéma such as offers and surveys.
If you no longer wish to receive information by e-mail, you can unsubscribe via the link at the bottom of every electronic newsletter.

  1. What about recording phone calls?

Libéma reserves the right to record telephone conversations. She will only use these recordings for internal purposes (training). The recordings will not be redistributed or provided to third parties.

  1. What about the use of your data if you use a link on our website to a third party website?

On the Websites it is possible to click through to the websites of other companies, not affiliated with Libéma. Libéma is not responsible for the processing of personal data by these other companies. Libéma recommends that you carefully read the privacy policies of these companies because the terms and conditions stated on those websites may differ from Libéma’s privacy policies.

  1. Who has access to your data and to which third parties do we provide your data?

At Libéma, only authorized personnel have access to this data.

If partners of Libéma take care of (part of) the processing of personal data, Libéma has agreed with them that they will also optimally protect the personal data and Libéma only does this if these third parties only use the data in a way and for a purpose related to the purpose for which they obtained the data, and only in accordance with this privacy statement. Furthermore, the confidentiality obligations and security measures required by law always apply to prevent your personal data from being disclosed to other parties. In some cases, Libéma must also provide data to third parties on the basis of a legal obligation. We always look at how your right to privacy can be respected as much as possible. If your data is transferred outside of Europe, for example because a data center or our supplier is located there, this will only take place under the conditions set by law.

  1. What rights do you have in connection with the use of your data?

You can object to the use of your personal data, for example if you believe that the use of your personal data is not necessary for the performance of Libéma’s activities or to comply with a legal obligation.

You have the right to inspect your personal data. This means that you can request which personal data has been registered about you and for what purposes that data is used. If you believe that Libéma has incorrect personal data about you, you can have this personal data corrected. You can request that the processing of your personal data be limited, including for the period necessary to assess your requests or objections.

You can request that your personal data be removed from the systems or that your personal data be transferred to a third party.

Your request will of course be met, unless Libéma has a compelling, legitimate interest not to delete the data, which outweighs your privacy interest. If the data has been deleted, not all copies of the data can be immediately deleted from the systems and backup systems for technical reasons. Data requests may be denied if they are made unreasonably frequently, require unreasonably heavy technical effort, or have unreasonably heavy technical impact on systems or endanger the privacy of others.

You can make your request or objection known by sending a message with your name, address and telephone number to privacy@libema.nl. You will receive an answer within a month.

If you have a complaint about the use of your personal data by Libéma, you can contact us via the number 073-5282200 (on working days between 09:00 and 17:00) and by email:  privacy@libema.nl.

  1. How do we protect your data?

Libéma makes every effort to protect your personal data against unauthorized use as much as possible, by taking all reasonable, appropriate security measures to protect Libéma and our relations and employees against unauthorized access or alteration, disclosure or destruction of personal data. Libéma complies with the applicable security standards.

If, despite the security measures, there is a security incident that is likely to have an adverse effect on your privacy, you will be informed about the incident as soon as possible. You will therefore be informed about the measures we have taken to limit the consequences and prevent a recurrence in the future.

The basic principles of our internal privacy policy are:

  • we only collect, use and store data when there is no other way to achieve the same purpose;
  • the more privacy-sensitive the information about you, the less we use the data;

Libéma sometimes adjusts the privacy statement, for example if there are changes in the law. You will find the applicable version of the privacy statement on our Websites. If we make material changes, we will provide more prominent notice, for example via our website or by email.

If you want to view your data, have it corrected or object to the use of your data by Libéma, you can contact us by telephone or e-mail. Libéma will then send you an overview by e-mail with the data known and registered at Libéma at that time.
